Rachel specialises in commercial litigation and insolvency.

She has provided advice on significant and complex contractual disputes and general commercial and litigation advice to a range of corporate clients. Rachel has particular expertise in contract, banking and insolvency litigation.

Rachel rejoined Bell Gully after working in the United Kingdom for three years. From 2003 to 2007 she worked in Bell Gully's Wellington office advising clients on a wide range of disputes. During this time, Rachel appeared in the High Court, District Court and arbitration tribunals on behalf of clients. She was also seconded to ANZ Bank for four months, as corporate counsel. She recently returned to ANZ Bank on a part-time secondment advising on debt recovery avenues for complex files.

Contractual disputes
Acting for receivers of the Kawarau Falls development, seeking enforcement of sale and purchase agreements in respect of buildings in the first stage of a development.

Acting for a manufacturing company in litigation arising out of the sale and purchase of a brand name. This included a successful hearing involving expert economists on the quantification of damage to the brand caused by breaches of post sale covenants and a successful appeal to the UK Supreme Court on the right to withhold a portion of the purchase price.

Banking
Acting for financial institutions in the UK and New Zealand in relation to negligent investment advice claims.

Acting for ANZ Bank in respect of a number of banking matters, including recovery of mistaken payments, recovery of loans, fraud, applications to injunct mortgagee sales and litigation against negligent valuers and solicitors.

Insolvency work
Acting for the receivers of Pike River Coal Limited (in receivership) in successfully obtaining court orders providing relief from cancellation of an integral lease of land.

Advising the liquidators of the Ross Asset Management Group of entities (in liquidation) on options to maximise recovery for investors.

Advising in an extensive insolvency investigation, in which a substantial trade creditor had not obtained security for its goods and was investigating any possible avenues of recovery, including actions against the directors for breach for their directors' duties.
